Abstract
The study addressed the legal framework for maritime fishing in Algerian legislation and international agreements, focusing on identifying the deficiencies and legal gaps in national texts that may hinder the development of the fishing sector and attract investment therein. It also assessed the efficiency of these texts and their contribution to managing and sustaining fishery resources while protecting them from overexploitation. Additionally, the study highlighted the international cooperative framework regulating this field through international and regional agreements, as well as the role of international organizations such as the Food and Agriculture Organization (FAO) in this domain. Furthermore, it analyzed the extent to which signatory countries comply with the provisions of these agreements and harmonize their local legislation with them Résumé L'étude a examiné le cadre juridique de la pêche maritime dans la législation algérienne et les accords internationaux, en mettant l'accent sur l'identification des lacunes et des failles juridiques dans les textes nationaux qui pourraient entraver le développement du secteur de la pêche et l'attraction des investissements. Elle a également évalué l'efficacité de ces textes ainsi que leur contribution à la gestion et à la durabilité des ressources halieutiques, tout en protégeant celles-ci contre l'exploitation excessive. Par ailleurs, l'étude a mis en lumière le cadre de coopération international régissant ce domaine à travers les accords internationaux et régionaux, ainsi que le rôle des organisations internationales telles que l'Organisation des Nations Unies pour l'alimentation et l'agriculture (FAO) dans ce contexte. Enfin, elle a analysé dans quelle mesure les États parties respectent les dispositions de ces accords et harmonisent leurs législations nationales avec celles-ci. |
