الدستور ليس مجرد نصوص تجمع من هنا وهناك بل هو تعبير عن السلطة التأسيسية من جهة، وتعبير عن الإيديولوجية السائدة في البلاد من جهة أخرى، فالهدف الأسمى للمؤسس الدستوري هو صنع دستور ذي جودة يتمتع بالقدسية والإحترام في نظر الأفراد ويضبط عمل المؤسسات الدستورية. وهو الذي تستمد منه باقي النصوص القانونية شرعيتها باعتباره أعلى درجة في الهرم القانوني، كما أن جودة الدستور هي الكفيلة بالترجمة الصادقة لمضمون النص الدستوري وإعطائه الشكل العملي الذي يصلح به للنفاذ.
فجودة الدستور هي التي تستطيع تحقيق التوازن بين صيانة الحقوق والحريات للأفراد من جهة وبين هيبة الدولة وفرضها للنظام العام من جهة أخرى، وبذلك يكون الدستور اللبنة الأولى والأساسية لدولة القانون.وللوصول إلى تلك الجودة المنشودة لابد من توافر مجموعة من المعايير والآليات. ولا تكتمل الجودة إلى بتوفير الحماية للدستور من تعدي السلطات ومخالفاتها لأحكامه من خلال آليات تحميه. La qualité de la constitution et les mécanismes de sa protection Etude comparative Résumé : La constitution n'est pas seulement des textes recueillis ici et là, mais c'est plutôt une expression de l'autorité constituante d'une part, et une expression de l'idéologie dominante dans le pays d'autre part. C'est celui dont le reste des textes juridiques tirent leur légitimité, car c'est le degré le plus élevé dans la hiérarchie juridique, et la qualité de la constitution est la garantie d'une traduction honnête du contenu du texte constitutionnel et de lui donner la forme pratique dans laquelle elle se prête à l'exécution. La qualité de la constitution est celle qui permet d'atteindre un équilibre entre la préservation des droits et libertés des individus d'une part, et le prestige de l'État et son imposition de l'ordre public d'autre part, et ainsi la constitution est la première et élément de base de l'état de droit. Afin d'atteindre cette qualité souhaitée, un ensemble de normes et de mécanismes doit être disponible. La qualité n'est pas complète en protégeant la constitution contre l'empiétement des autorités et les violations de ses dispositions par le biais de mécanismes qui la protègent. The quality of the constitution and the mechanisms for its protection A comparative study Abstract : The constitution is not just texts collected from here and there, but rather it is an expression of the constituent authority on the one hand, and an expression of the prevailing ideology in the country on the other hand. It is the one from which the rest of the legal texts derive their legitimacy, as it is the highest degree in the legal hierarchy, and the quality of the constitution is the guarantee of an honest translation of the content of the constitutional text and giving it the practical form in which it is suitable for enforcement. The quality of the constitution is the one that can achieve a balance between preserving the rights and freedoms of individuals on the one hand, and the prestige of the state and its imposition of public order on the other hand, and thus the constitution is the first and basic building block of the state of law. In order to reach that desired quality, a set of standards and mechanisms must be available. The quality is not complete by providing protection to the constitution from the authorities’ encroachment and violations of its provisions through mechanisms that protect it. |
