الملخص:
تكتسي حرية المنافسة أهمية بالغة في النظام االقتصادي الحالي، إال أن هذا المفهوم يمتدإلى المساس والتأثير على األبعاد األخرى خاصة الجانب المتعلق بالمستهلك ألن هذا األخير عنصر أساسي لتجسيد فكرة حرية المنافسة،نظر االتساع اختالل التوازن بين المستهلك كطرف ضعيف في العالقة االقتصادية، وبين العون االقتصادي الذي يهمن على تلك العالقةبقوتهاالقتصاديةوكفاءته التقنية في مجال اإلنتاج والتوزيع، كان لزاماعلى المشرع الجزائري تدخل بموجب قانون حمايةالمستهلك وقمعالغش،وكذاقانوني المنافسةوالممارسات التجارية بفرض جملةمن اآلليات الموضوعيةواإلجرائيةعلى العون االقتصادي،والتي من شأنهاحماية حقوق المستهلك وتحقيق عالقة اقتصادية متوازنة. La liberté de la concurrence joue un rôle d'une grande importance dans le système économique actuel attendu que ce concept s'étend pour atteindre et exercer une influence sur les autre repères notamment le coté du consommateur vu que ce dernier est un élément essentiel pour la concrétisation de la libertés de la concurrence suite à la croissance du déséquilibre entre le consommateur comme partie faible dans le rapport économique et entre l'agent économique qui règne sur cette relation par l'exercice de la puissance économique et sa compétence technique dans le domaine de la production et la distribution. Le législateur Algérien été dans l'obligation d'intervenir conformément à la loi du consommateur et la lutte contre la fraude, ainsi que la loi sur la concurrence, les conditions d'exercice des Activités commerciales en imposant un ensemble de mécanismes objectives et procédurales sur l'agent économique, dans le but de d'offrir une protection des droits du consommateur et instauré une relation économique équilibrée. Abstract The freedom of competition have a great importance in the current economic system, given that this concept extends to reach and exert an influence on the other benchmarks in particular the side of the consumer which is essential element for the realization of the freedoms of competition, following the growth of the imbalance between the consumer as a weak party in the economic relationship, and between the economic agent who reigns over this relationship through the exercise of economic power and his technical competence in the field of production and distribution. The Algerian legislator was obliged to intervene in accordance with consumer law and the fight against fraud, as well as the law on competition, the conditions of exercise of commercial activities by imposing a set of objective and procedural mechanisms on the economic agent, with the aim of offering protection of consumer rights and establishing a balanced economic relationship. |
