الملخص:
لقد عرف المجتمع الدولي على مستوى النشاط الاقتصادي عدة تحولات، فرضت على مكوناته التوجه نحو الانفتاح ورفع الحواجز، لبناء نظام اقتصادي جديد يستطيع تحقيق التنمية على جميع المستويات، إلا إن هذه التطورات أثرت سلبا على قدرة الدول في توفير مناصب شغل ،كما تسببت في صعوبات اقتصادية للمؤسسات المستخدمة أدت بها إلى تسريح بعض العمال من أجل الحفاظ على كيانها ، و لذات الأسباب ظهرت الحاجة إلى اعتماد نظام قانوني بديل، يكون هدفه الأول توفير مناصب شغل جديدة و المحافظة على مناصب الشغل المتوفرة ، مع ضمان بقاء هذه المؤسسة، و لذلك تسعى هذه الدراسة إلى تسليط الضوء على وسيلة تقسيم العمل لخلق مناصب شغل جديدة عندما يقل حجم العمل المتوافر بداخل المؤسسة عن المدة القانونية للعمل و الحفاظ على مناصب الشغل المتوفرة في إطار الجانب الاجتماعي تفاديا لتقليص العمال اقتصاديا و بذلك يتم التوفيق بين الظروف الاقتصادية للمؤسسة والمحافظة على استمرارها من جهة والحفاظ على الاستقرار الاجتماعي للطبقة العاملة و حمايتها من البطالة من جهة ثانية . Le partage du travail comme moyen de préservation de l’emploi et de résorption du chômage » Résumé : Des changements de l'activité économique mondiale ont contraint les Etats à revoir leur politique économique en optant pour l’ouverture de l’économie et l’élimination des entraves à l'élaboration d'un système économique mondial nouveau garantissant le développement à tous les niveaux ; néanmoins ce dernier a eu un impact négatif sur les économies de certains pays qui ne pouvaient plus créer des postes de travail en ayant recours aux licenciement massifs et à la suppression de postes de travail pour éviter la fermeture des entreprises. Des études œuvrent pour me mettre en place un système juridique de substitution garantissant la création de postes de travail dans le cadre d’activité à temps partiel et éviter la suppression de postes de travail due au licenciement collectif dans le but de maintenir l’entreprise sauve et stable tout en prenant en considération la fragilité de certaines entreprises et permettre sa pérennité d'une part et protéger la classe ouvrière du spectre du chômage d’autre part. « works sharing to preserve jobs and eliminate unemployment » Abstract : The international community has undergone several transformations at the level of economic activity, which forced its components to move towards openness and removing barriers, in order to build a new economic system that can achieve development at all levels. However, these changements have negatively affected the ability of countries to provide jobs, and caused economic difficulties for the employing institutions, which led them to lay off some workers in order to preserve their existence. For the same reasons, the need arose to adopt an alternative legal system, in which the primary objective would be to provide new job positions and to preserve the available ones, with the assurance of the survival of this institution. That’s why, this study seeks to shed light on the method of labor division to create new job positions when the volume of work available within the institution is less than the legal period of work and to maintain the available job positions within the framework of the social aspect in order to avoid reducing workers economically, and thus reconciling the economic conditions of the institution and Preserving its continuity on the one hand and preserving the social stability of the working class and protecting it from unemployment on the other hand key words Division of labor, job creation, elimination of unemployment, layoffs for economic reasons, part-time employment contract. |
