Abstract:
This study includes the Judge 's discretion and its restrictions.
After realizing the importance of this issue in the investigation, and the
ruling where there is no investigation, and no judgment without a judge, we
carried out the study hereof. The " old and contemporary " jurists differed their
view regarding the origin of the discretionary power of the judge, some of them
admit its existence in criminal jurisprudence. By contrast, some deny it.
However, the confessors of the judge’s discretion disagreed. There are
those who chose moderation, while others went to overestimate that
discretionary authority to the degree that resembles a controlling authority.
The study hereof, by presenting the discretionary power exercised by judge,
clarified the most important power of the judge in the investigation. It also
showed that the judge’s discretionary authority, in the various stages of the
judiciary, is an authority disciplined with controls that protect it from
arbitrariness and tyranny.
