الملخص باللغة العربية:
ضوابط الاقتناع الشخصي للقاضي الجزائي يقتضي الفصل في موضوع الدعوى العمومية إصدار القاضي الجزائي لحكم قضائي قد يتضمن إمّا براءة المتهم أو إدانته حسب ما ثبتّ لديه، ولا يعني هذا التطبيق الجامد للنص القانوني على الواقعة الاجرامية الثابتة؛ إذ يتطلب الأمر بذل القاضي نشاطا ذهنيا منطقيا مستندا في ذلك إلى كفاءته العلمية والعملية في تحليل وتمحيص للأدلة الجنائية المقدمة ليخلُص في الأخير إلى تجسيد ما استقر في ذهنه وضميره وما تولد في نفسيته حول الحقيقة الواقعية في مضمون الحكم القضائي الّذي يصدره، وباعتبار أنّ الاقتناع القضائي المتوصل إليه في أصله هو اقتناع القاضي الجزائي؛ فإنّه وضمانا لسلامة سير عملية الاقتناع وصحته فلابّد من وجود ضوابط شخصية وموضوعية وجب على القاضي مراعاتها والتقيّد بها ضمانا لسلامة عمله القضائي وصحة الحكم الجزائي الصادر عنه. لخص باللغة الفرنسية: Contrȏles de conviction personnelle du juge pénal Résumé : La décision au sujet d’une action publique nécessite la publication d’une décision judiciaire par le juge pénal, qui inclut soit l’innocence soit la condamnation de l’accusé , comme l’a prouvé le juge.Cette application rigide du texte juridique ne signifie pas la rélatité criminelle perpétuelle, mais oblige le juge à ȇtre convaincu da son activité mentale , basée sur sa compétence, analyse scientifique et pratique et examen de la preuve médico-légale présentée afin de sauver finalement l’incarnation de ce qui était établi dans son esprit et sa conscience et a généré la conviction dans sa conviction de la réalité du contenu de la décision judiciaire rendue , et la condamnation judiciaire à l’origine est la condamnation du juge pénal afin de garantir l’ intégrité du processus de condamnation et de santé, des contrȏles personnelles objectifs doivent ȇtre pris en compte et le juge doit garantir l’intégrité de son travail judiciare et la validité du jugement pénal qu’il a rendu الملخص باللغة الانجليزية: The conditions of the personal conviction of the criminal judge Abstract : To make a judgement in the subject of the public claim the judicial judge must issue a judicial judgement which contains eighter a condemntion or innocence of the accused according to what he is rest assured.However , this doesn’t mean the rigid application of the legislative text on the fact of the existant crime , it should have the conviction of the judge in which he makes efforts through a logical thinking depending on his competence ; thinking and practical to analysis deeply of the present criminal proofs in order to applied at last what he has believed and according to his concience and also to his psychology of the conviction about the real fact in the consistance of the criminal judgement which he passes ,in addtion,this conviction which it is reached in its origin is a judicial judge‘s conviction and so to guarantee the safety of the conviction‘s operation and it’s validity .The judge must take in consideration the personal and the subjective regulations,he is obligated to work according to them ,for his judicial work ‘s safety and the validity of the criminal judgement which it is passed by him |
