تكمن أهمية هذه الحماية في أن وجود التلوث في مكان ما من العالم لا يؤثر في المنطقة الموجود فيها فقط بل يتعدى الحدود السياسية والجغرافية بدون استئذان، وبذلك يحدث ضرر يعرض الحياة التي تعيشها للخطر. لذلك لم تعد القضية البيئية محليةأو قومية تعاني منها دولة تحاول السيطرة عليها بوسائل محلية أو وطنية، بل أصبحت قضية ذات طابع عالمي. وعليه فلا سبيل لاستمرار الحياة، إلا من خلال وضع استراتيجيات وسياسات للتنمية يعتمد على أسس بيئية لتحقيق التوازن الايكولوجي وقدرة الأنظمة البيئية على الإنتاج الطبيعي للموارد، وهذا ما أدى إلى ظهور مفهوم التنمية المستدامة التي تلزمنا أن لا نورث هذه الأجيال مشاكل صعبة الحل، لأنه من حقها أن تستلم بيئة نظيفة خالية من الملوثات، ما يقتضي ضبط السلوك في التعامل مع موارد البيئة الطبيعية ونشر الوعي البيئي والمشاركة الرسمية والشعبية الفاعلة على الصعيدين الوطني والعالمي، وخاصة بعد ظهور الثورة الصناعية في القرن 19 والتطور التكنولوجي الموازي لذلك، مع احترام تطبيق القوانين الخاصة بالبيئة.
ولذلك كانت إشكالية الدراسة على النحو التالي:''إلى أي مدى يتم التوفيق بين التنمية و حماية البيئة ؟''. حيث تكونت هذه الدراسة من مقدمة وبابين وأربعة فصول و خاتمة. تناولت في "الباب الأول": واقع البيئة و مشكلاتها، و قسمته إلى فصلين: الفصل الأول: البيئة والتلوث والفصل الثاني: الأمن البيئي و التنمية المستدامة. كما تناولت في"الباب الثاني": الآليات القانونية لحماية البيئة في ظل التنمية المستدامة وقسمه إلى فصلين:الفصل الأول: جهود المنظمات و المؤتمرات الدولية في حماية البيئة في ظل التنمية المستدامة.والفصل الثاني: دور القانون البيئي في تحقيق التنمية المستدامة. وتوصلت في الخاتمة إلى استنتاجات وتوصيات نابعة منصلب الموضوع محل الدراسة Résumé: Protection juridique de l'environnement contre la pollution dans le cadre du développement durable L'importance d'une telle protection réside dans le fait que la présence de pollution dans certaines parties du monde affecte non seulement la zone dans laquelle elle est située, mais aussi les frontières politiques et géographiques sans autorisation, Par conséquent, causer du tort à la vie que vous vivez. Par conséquent, le problème environnemental n'est plus un problème local, ou une nation qui souffre d'un état qui essaie de le contrôler par des moyens locaux ou nationaux, mais qui est devenu un problème mondial., Par conséquent, il n'existe aucun moyen de continuer la vie, sauf à travers le développement de stratégies environnementales et de politiques de développement environnemental pour atteindre l'équilibre écologique et la capacité des écosystèmes à produire des ressources naturelles. Cela a conduit à l'émergence du concept de développement durable, qui nous oblige à ne pas causer de problèmes difficiles à ces générations. Parce qu'il a le droit de recevoir un environnement propre exempt de polluants, nécessite la régulation du comportement dans le traitement des ressources de l'environnement naturel et la diffusion de la conscience environnementale et la participation officielle et populaire aux niveaux national et mondial, Surtout après l'émergence de la révolution industrielle au 19ème siècle et le développement technologique parallèle, tout en respectant l'application des lois environnementales. Par conséquent, le problème de l'étude était le suivant: "Dans quelle mesure le développement et la protection del'environnement sont-ils réconciliés?", Cette étude a consisté en une introduction, deux chapitres, quatre chapitres et une conclusion. J'ai traité de "la première section": la réalité de l'environnement et de ses problèmes ,et Divisé en deux chapitres: Chapitre I: Environnement, Pollution et Chapitre II: Sécurité environnementale et développement durable.et Le deuxième section traite des mécanismes juridiques pour la protection de l'environnement dans le contexte du développement durable, Il l'a divisé en deux chapitres: Chapitre I: Efforts des organisations internationales et des conférences sur la protection de l'environnement à la lumière du développement durable. Chapitre II: Le rôle du droit de l'environnement dans la réalisation du développement durable. En conclusion, j'ai abouti à des conclusions et à des recommandations découlant de la substance du sujet à l'examen.
