الملخص:
لقد تمّ التطرق من خلال الرسالة الموسومة بجريمة الاستخدام غير المشروع لفضاء الإنترنيت إلى دراسة مختلف الجرائم المرتكبة نتيجة الاستخدام غير القانوني للشبكة العنكبوتية وفق التشريع الجزائري، حيث تمّ بحث الجوانب المتصلة بتحديد المقصود بهذا النوع من الإجرام المستحدث، وتسليط الضوء على الخصوصية التي تميزه عن غيره من الجرائم الأخرى، وما أقره المشرع الجزائري من خصوصية إجرائية لشتى المراحل التي تمر بها هذه الجريمة، وكذا تصنيف الجرائم المرتكبة عبر الإنترنت في ضوء التعديلات المتلاحقة لقانون العقوبات الجزائري ومختلف القوانين الخاصة .حيث تم التطرق إلى الخصوصية التي تتسم بها جرائم الاستخدام غير المشروع لفضاء الإنترنيت من حيث خصوصية إطارها المفاهيمي، و الخصوصية الإجرائية المقررة لها وفقا للتشريع الجزائري، بالإضافة إلى دراسة الأحكام الموضوعية الخاصة بها من خلال تصنيفها وفقا لقانون العقوبات الجزائري، وكذا التصنيف المحدد بموجب القوانين الخاصة. Crime d’utilisation non planifiée de l’espace d'Internet » Résumé : À travers la lettre étiquetée du délit d'utilisation illégale de l'espace Internet, une étude des différents délits commis à la suite de l'utilisation illégale du World Wide Web conformément à la législation algérienne a été abordée. D'autres délits, et la spécificité procédurale approuvée par le législateur algérien pour les différentes étapes que traverse cette infraction, ainsi que la classification des infractions commises via Internet à la lumière des modifications successives du Code pénal algérien et des différentes lois spéciales. Lorsque la confidentialité des délits d'utilisation illicite d'Internet a été abordée au regard de la confidentialité de son cadre conceptuel, et de la spécificité procédurale qui lui est prescrite conformément à la législation algérienne, outre l'étude de ses dispositions de fond à travers sa classification selon la Code pénal algérien, ainsi que la classification spécifique en vertu des lois spéciales.
