تتناول الأطروحة تبيانا واضحا لحقوق المؤلف بداية من جذورها التاريخية الى غاية ما وصلت اليه في العصر الحديث ،ثم تفصيل محتوى هذه الحقوق في مضمونها الادبي و المالي وصولا الى ما انبثق عنها من حقوق أخرى مرتبطة بها عرفت بالحقوق المجاورة ،هذا في الباب الأول ،لننتقل فيما بعد إلى لب الدراسة بتحديد المصنفات المحمية بموجب التشريعات الوطنية الجزائية و موقف المواثيق الدولية من هذه الحماية الجنائية .
أما في الباب الثاني فتمحورت الدراسة حول أساليب الحماية الجزائية و الأشخاص المخول لهم ممارستها ،لننتقل ختاما إلى الدعوى الجزائية و الجزاءات المقررة La thèse prends une explication claire des droits de l’auteur dès leurs racines historiques à ce qu’ils ont atteint dans l'ère moderne , puis détailler les différents contenus de ces droits moral et financier dans la mesure où ils ont surgi des autres droits associés, qui sont connus par les droits voisins.qui ont été sité dans la première porte,passons au coeur de l'étude par la précision des ouvres sécurisé et protégé par la législation pénale et la position des instruments internationaux sur cette protection pénale. Dans la deuxième partie, l’étude porte sur les méthodes de protection pénale et les personnes autorisées à les exercer. Et en conclusion, passons à la défense des droits et des sanctions pénales. Abstract : The thesis deals with a clear statement of copyright, starting from its historical roots until what it has reached in the modern era, then detailing the content of these rights in their literary and financial content to what emerged from them from other rights associated with them known as neighboring rights, in the first chapter, to move later to the core of the study by identifying works protected under national penal legislation and the position of international conventions on this criminal protection. In the second section, the study focused on the methods of penal protection and the persons authorized to exercise it, to move finally to the criminal case and the prescribed penalties |
