أدى تبني الجزائر للنظام الرأسمالي إلى انسحابها عن إدارة وتنظيم المؤسسات العمومية الاقتصادية ، ومنحها استقلالية ولوفي حدود
معينة، لادارة أموالها والتعاقد مع مسيريها، الذين أصبحوا مجرد أجراء يخضعون في علاقاتهم مع المؤسسات التي يديرونها لازدواجية تشريعية يضبطها كل من قانون علاقات العمل والقانون التجاري، خلق هذا الوضع ميلاد علاقات عمل جديدة تخص فئة هؤولاء المسيريين بعد دخول المرسوم التنفيذي رقم09-009املتعلق بالنظام الخاص بعلاقات العمل الخاصة بمسيري المؤسسات حيز التنفيذ، الذي خصهم بنظام نوعي خاص جعلهم في مركز قانوني ذو طبيعة مزدوجة، فمن جهة يعتبرون كأجراء يخضعون احتياطيا لقانون علاقات العمل طبقا لنص المادة 04 منه، من حيث إنشاء علاقة عملهم، وطرق إثباتها، والاثار المترتبة عنها، ومن جهة أخرى ينظر إليهم كممثلين أو وكلاء عن المؤسسة التي يديرونها، وهذا بالنظر إلى المستويات الكبيرة لاجورهم ومدى اتساع سلطاتهم، ونوعية التزاماتهم. L’adoption du système capitaliste par l’Algérie a conduit à se retirer de la gestion et de la régulation des institutions économiques publiques, et à leur accorder l’indépendance, même dans des certaines limites, pour gérer leurs fonds et contacter avec leurs dirigeants, qui sont devenus de simples salariés soumis dans leurs relations avec les entreprises qu’ils gèrent la duplicité législative régie à la fois par la loi sur les relations de travail et à la loi commerciale, cette situation a créer la naissance de nouvelles relations de travail appartenant à la catégorie de ces cadres après l’entrée en vigueur du décret exécutif n0 90-290 relatif au régime des relations de travail des cadres des établissements, qui les affectait à un régime qualitatif particulier qui les plaçait dans une situation juridique à double caractère, relations de travail conformément aux dispositions de l’article 04 de celle-ci, en termes d’établissement de leur relation de travail, de modalités de sa preuve et de ses conséquences, d’autre part, ils sont perçus comme des représentants ou des agents de l’institution qu’ils dirigent, compte tenu du niveau élevé de leurs salaires de l’étendue de leurs pouvoirs et de la qualité de leurs obligations. Algeria’s adoption of the capitalist system has resulted in its withdrawal from the administration and management of public economic institutions, granting it independence, even within certain limits, to manage its funds and contract with its managers, who have become mere employees in their relationship with the enterprises they run, subject to legislative duplication regulated by both the labour relations act and the commercial act, this situation created the birth of new labour relations for the category of such marchers after the entry into force of executive decree no 90-290 on the system for the employment relations of enterprise managers legal status, which concerned them with a special qualitative regime that placed them in a legal status of a dual nature, on the one hand, they are deemed to be remedied under labour relations act in accordance with article 04 there of working relationship, in terms of the establishment of their working relationship, the methods and implications of establishing them, on the other hand, they are seen as representatives or agents of the institution they run, given their high levels of remuneration, the breadth of their powers and the quality of their obligations. |
