.اتفاقية تفويض المرفق العام، هي عقد إداري، تبرمها الادارة باعتبارها سلطة عامة، وتسمى السلطة المفوضة ، مع أحد أشخاص
القانون العام أو الخاص، ويسمى المفوض له، توكل له بموجبها مهمة تسيير وإدارة مرفق عام، تحت إشرافها ورقابتها، بهدف تقديم خدمة عمومية ضرورية للجمهور، وتحقيق المنفعةالعامة. وتتمتع هذه الاتفاقية ، بنظام قانوني خاص، هو موضوع دراستنا هاته. La convention de délégation de service public est un contrat administratif, conclu par l’administration en tant qu’autorité publique, appelée autorité déléguée, avec une personne de droit commun ou privé, et le commissaire est chargé de gérer et de gérer un établissement public, sous sa supervision et son contrôle, dans le but de fournir un service public nécessaire au public et dans l’intérêt public. Cette Convention a un système juridique spécial, qui fait l’objet de notre étude. The convention on the delegation of the public service is an administrative contract, concluded by the Administration as a public authority, called the delegated authority, with a person of common or private law, and the commissioner is assigned the task of running and managing a public facility, under its supervision and control, with the aim of providing a public service necessary to the public and in the public interest. This Convention has a special legal system, which is the subject of our study. |
