يشكّل عقد تفويض المرافق العامة أسلوبًا حديثًا لإدارة المرفق العام، برز مع تراجع دور الدولة من الاحتكار والتدخل المباشر إلى الاكتفاء بالضبط والتوجيه، مما أتاح مساحة أكبر لمبادرة الخواص والمتعاملين الاقتصاديين لتقديم خدمة عمومية أكثر جودة وفعالية. وقد انتشر هذا النموذج في العديد من الدول كفرنسا والمغرب وتونس والكويت والعراق والجزائر، رغم اختلاف المصطلحات المعتمدة بينها، إلا أنّها تتفق في الهدف المتمثل في تطوير الخدمات المرفقية.
وتُعدّ التجربة الفرنسية رائدة في هذا المجال بفضل مساهمة التشريع والقضاء، وهو ما انعكس في قوانين مثل سابان ومارسيف. وفي الجزائر، لم يكن التشريع بعيدًا عن هذا التطوّر، حيث جاء المرسوم الرئاسي 15/147 والمرسوم التنفيذي 18/199 ليؤسّسا إطارًا قانونيًا مفصّلًا يهدف إلى معالجة نقائص المراحل السابقة وتحرير القطاع الإداري من الهيمنة، بما يضمن تقديم خدمة عامة أكثر جدوى ومرونة مواكبة لاحتياجات المجتمع. Abstract: The public service delegation contract represents a modern method of managing public services, emerging as the role of the State shifted from monopoly and direct intervention to a function limited to regulation and guidance. This shift has provided greater room for the initiative of private and economic operators to deliver higher-quality and more efficient public services. This model has spread across many countries such as France, Morocco, Tunisia, Kuwait, Iraq, and Algeria. Despite differences in terminology, these countries share the same goal: developing public service delivery. The French experience is considered pioneering in this field due to the contribution of legislation and case law, reflected in laws such as Sapin and Murcef. In Algeria, legislation has also kept pace with this evolution through Presidential Decree 15/147 and Executive Decree 18/199, which established a detailed legal framework aimed at addressing previous shortcomings and freeing the administrative sector from dominance, thereby ensuring a more effective, useful, and flexible public service that meets the needs of society. Résumé : La délégation de service public constitue une méthode moderne de gestion du service public, apparue avec le recul du rôle de l’État, passé du monopole et de l’intervention directe à une fonction limitée à la régulation et à l’orientation. Cette évolution a offert un espace plus large à l’initiative des opérateurs privés et économiques pour fournir un service public de meilleure qualité et plus efficace. Ce modèle s’est répandu dans de nombreux pays, tels que la France, le Maroc, la Tunisie, le Koweït, l’Irak et l’Algérie. Malgré la diversité des terminologies adoptées, ces pays convergent vers le même objectif : le développement des services publics. L’expérience française demeure pionnière dans ce domaine grâce à l’apport du législateur et de la jurisprudence, ce qui s’est reflété dans des lois telles que Sapin et Murcef. En Algérie, la législation a également suivi cette évolution, avec le décret présidentiel 15/147 et le décret exécutif 18/199, qui ont établi un cadre juridique détaillé visant à corriger les insuffisances précédentes et à libérer le secteur administratif de l’hégémonie, garantissant ainsi un service public plus utile, efficace et flexible, en phase avec les besoins de la société. |
