الملخص: يكتسي الأمن القانوني أهمية بالغة في مجال الاستثمار، حيث يساهم في إرساء منظومة قانونية واضحة ومستقرة تسمح باستقطاب رؤوس الأموال وتعزيز الثقة في الأنظمة القانونية والمؤسساتية المشرفة على الاستثمار وترقيته بالجزائر، الأمر الذي يُمكن المستثمر من اتخاذ قراراته الاستثمارية ضمن مناخ استثماري آمن ومحفز. وتكريساً لذلك، حرص المشرع الجزائري من خلال القانون 22-18 المتعلق بالاستثمار على توفير جملة من المزايا والتحفيزات، إلى جانب الضمانات الموضوعية والإجرائية الكفيلة بتأمين العملية الاستثمارية في مختلف مراحلها، كما تم تدعيم هذا التوجه بإبرام الجزائر للعديد من الاتفاقيات الدولية الثنائية والمتعددة الأطراف بهدف ترقية المناخ الاستثماري بالجزائر. كلمات مفتاحية: الأمن القانوني، الإستثمار، الإستقرار التشريعي، حرية الإستثمار، الشفافية، المساواة، الضمانات، المزايا، منازعات الإستثمار، الاتفاقيات الدولية، القرار الاستثماري. « La sécurité juridique et son rôle dans la promotion de l’investissement» Résumé : La sécurité juridique revêt une grande importance dans le domaine de l’investissement, car elle contribue à l’établissement d’un système juridique clair et stable, permettant d’attirer des capitaux et de renforcer la confiance dans le système juridique et institutionnel encadrant et promouvant l’investissement en Algérie. Cela permet à l’investisseur de prendre ses décisions dans un climat d’investissement sécurisé et incitatif. Dans ce contexte, le législateur algérien, à travers la loi n° 22-18 relative à l’investissement, a veillé à offrir un ensemble d’avantages et d’incitations, ainsi que des garanties matérielles et procédurales destinées à sécuriser le processus d’investissement à ses différentes étapes. Cette orientation a également été renforcée par la conclusion de nombreux accords internationaux, bilatéraux et multilatéraux, qui visent à la promotion du climat d’investissement en Algérie. This enables the investor to make investment decisions within a secure and conducive investment climate. Accordingly, the Algerian legislator, through Law No. 22-18 on Investment, has sought to provide various advantages and incentives, alongside substantive and procedural guarantees, to secure the investment process at its different stages. This approach has also been reinforced by Algeria's conclusion of numerous international agreements, both bilateral and multilateral, aimed at promoting the investment climate in Algeria |
